PLATFORM TERMS OF USE

1. GENERAL PROVISIONS

1.1 Definitions
· Platform – the website available at kguard.learnworlds.com and based on the LearnWorlds platform
· User – a natural person or legal entity using the Platform
· Participant – a User who has purchased access to a training course or course
· Services – trainings, courses, and educational materials made available by KnowGuard
· KnowGuard – KnowGuard Sp. z o.o., the Platform administrator and owner
· LearnWorlds – the technical provider of the e-learning platform

1.2 Scope of the Terms
These Terms of Use govern:
· Use of the Platform
· Purchase of access to the Services
· Rights and obligations of the parties
· Disclaimers and limitations of liability
· Dispute resolution
The Terms constitute a binding agreement between the User and KnowGuard. By using the Platform, the User confirms acceptance of all provisions.

1.3 Amendments to the Terms
KnowGuard reserves the right to amend these Terms. Amendments shall take effect:
· For new Users – immediately upon publication
· For existing Participants – as of the date indicated in an email notice (at least 30 days)
· Continued use of the Platform constitutes acceptance of the amendments

2. REGISTRATION AND USER ACCOUNT

2.1 Registration Requirements
In order to register on the Platform, the User must:
· Be of legal age
· Provide true and up-to-date information
· Have a valid email address
· Accept these Terms and the Privacy Policy

2.2 Account Security
The User is responsible for:
· Keeping the account password confidential
· Maintaining the confidentiality of access credentials
· All activities performed using their account
· Promptly notifying KnowGuard of any unauthorized access

KnowGuard shall not be liable for loss of access to an account resulting from disclosure of the password.

2.3 Suspension and Closure of the Account
KnowGuard is entitled to:
· Suspend access to the Platform in the event of a breach of the Terms
· Close the account without a refund in the event of:
   o Repeated violations of applicable law
   o Fraud or manipulation
   o A security threat
   o Inappropriate conduct toward other users

The suspension procedure will be preceded by a notice, except in security-related cases.

3. TRAININGS, COURSES, AND EDUCATIONAL SERVICES

3.1 Access to the Services
After purchasing a course, the Participant receives:
· Access to training materials
· The ability to track progress
· Access to tests and quizzes
· The right to download certificates upon completion

3.2 Form and Delivery of the Services
The Services are provided:
· In electronic form – via the LearnWorlds Platform
· Online only – with no paper-based option
· On demand – 24/7 access for the period specified in the course description

The Participant must have Internet access and an appropriate device (computer, tablet, smartphone).
The agreement for the provision of electronic services is concluded upon creation of an account on the Platform, and the agreement for access to a given course is concluded upon successful payment.

3.3 Educational Materials
All educational materials (video, text, PDF, tests) are provided "AS IS" (as available). KnowGuard:
· Does not guarantee that all content is fully up to date
· Is not responsible for errors in the materials
· Reserves the right to update content without prior notice
· Exercises due care to keep materials current; however, it does not guarantee full accuracy at all times, and undertakes to update content within 7 business days of an error being reported

3.4 Certificates and Confirmations
Upon completing a course, the Participant may:
· Download a course completion certificate from the Platform
· Use the certificate for professional purposes
KnowGuard does not guarantee:
· Recognition of the certificate by third parties
· The certificate's value in the labor market
· Employment opportunities as a result of obtaining the certificate

The certificate is issued solely based on completion of the materials and passing the tests. The certificate does not constitute proof of professional qualifications within the meaning of applicable law, nor does it replace any legally required exams or licenses.

4. FINANCIAL TERMS

4.1 Prices and Payments
· Prices are stated in PLN (Polish zloty)
· The price includes VAT (if applicable)
· Payment is required before access is granted
· Access is activated promptly after the payment is credited
· For payments made from accounts held in a currency other than PLN, any currency conversion costs are borne by the Participant, in accordance with the terms and conditions of their bank or payment operator

4.2 Payment Methods
KnowGuard accepts various payment methods. Details are available via the link Payment Gateways : LearnWorlds Help Center.
· Credit cards (Visa, Mastercard)
· Bank transfers
· Electronic payment systems (PayPal, Stripe, etc.)
· Other methods indicated on the Platform
All transactions are processed through secure systems using SSL/TLS encryption.

4.3 Refunds (Refund Policy)
Right to a refund:
The Participant is entitled to a full refund of the amount paid in the following cases:
· A material defect in the course or course unavailability
· A technical issue preventing access
· Cancellation of the course by KnowGuard
Refund procedure:
· Refund requests must be submitted by email to: refund@knowguard.eu
· The request must include the order number
· Refund terms → LW link
Exclusions from the right to a refund:
· Courses marked as "non-refundable" (no refunds)
· The Participant has completed the course
· The 14-day period has elapsed and the course was available
· A refund requested due to the Participant's fault (e.g., forgetting the password)

4.4 Access Periods
· Time-limited access – the period indicated for the course (e.g., 1 year, 3 months)
· No access after the deadline – after the access period expires, the content becomes unavailable
The Participant is required to note down important information before the access period expires.
4.5 Payment Complaints
In the event of payment issues, the Participant should:
· Contact support at: info@knowguard.pl
· Provide the order number and payment details
A response will be provided within 72 hours if the request is submitted on business days.

5. USER RIGHTS AND OBLIGATIONS

5.1 Participant Rights
The Participant has the right to:
· Access purchased training materials
· Download the certificate upon completion
· Access all updated content
· Receive technical support in case of issues
· Cancel the account and request deletion of data (in accordance with GDPR)

5.2 Participant Obligations
The Participant undertakes to comply with:
Legality and ethics:
· Use the Platform exclusively in compliance with applicable law.
· Not use the Platform for purposes prohibited by law.
· Refrain from using language that constitutes hate speech.
· Respect intellectual property rights.
Security:
· Not share the password or other access credentials with third parties.
· Not make changes to other users' data.
· Not transfer the license to another person without KnowGuard's prior consent.
· Not compromise the security of systems, in particular through hacking or other technical manipulation.
Respect:
· Not engage in conduct that constitutes harassment or bullying of other participants.
· Not send spam or other unsolicited content on the Platform.

5.3 Prohibited Activities
The User may not:
· Create multiple accounts for fraudulent purposes
· Copy, reproduce, or distribute training materials beyond permitted personal use as specified in section 6.2
· Distribute Platform content
· Share access with other persons
· Use bots or automated tools to scrape content
· Reproduce, modify, or resell the Services
· Interfere with the operation of the Platform
· Collect data of other users

6. INTELLECTUAL PROPERTY RIGHTS

6.1 Ownership of Materials
All materials on the Platform (video, text, graphics, tests) are the property of KnowGuard or its licensors and are protected by copyright.

6.2 License for Use
KnowGuard grants the Participant a personal, non-transferable license to:
· View the materials
· Take notes for personal use
· Print the materials for personal use

6.3 Prohibited Use
The Participant may not:
· Copy, reproduce, or modify the materials
· Distribute the materials
· Create derivative works
· Trade in the materials
· Share access with others
Copyright infringement results in termination of the agreement and potential legal action.

6.4 Termination of the License
The license expires upon:
· Account cancellation
· Expiry of the access period
· Breach of the Terms
· A request by KnowGuard

7. LIABILITY AND LIMITATIONS

7.1 Disclaimers
KnowGuard does not guarantee:
· Uninterrupted access to the Platform
· The absence of errors or service interruptions
· Absolute security of data (although it takes all reasonable precautions)
· Suitability of the materials for specific purposes
· Compatibility of the User's systems with the Platform

7.2 Limited Liability
KnowGuard shall not be liable for:
· Loss of profits or revenue
· Indirect or consequential losses
· Damage to the User's IT systems
· Third-party content (links, advertisements)
· Actions of Providers
KnowGuard's maximum liability shall not exceed the amount actually paid by the Participant.

7.3 Force Majeure
KnowGuard shall not be liable for obstacles in providing the Services resulting from:
· Natural disasters
· War or riots
· Actions of public authorities
· Internet outages or global service disruptions
· Cyberattacks beyond KnowGuard's control
· LearnWorlds issues
In such cases, KnowGuard will endeavor to restore access as quickly as possible.

8. PRIVACY AND DATA PROTECTION

8.1 Data Processing
KnowGuard processes User personal data in accordance with the Privacy Policy available on the Platform. The User undertakes to familiarize themselves with this policy.

8.2 Security
KnowGuard implements data protection measures in compliance with GDPR, including:
· Data encryption
· Access control
· Regular security audits
· Incident response procedures

8.3 Cookies and Tracking
The Platform uses cookies and tracking technologies. Details are available in the Cookie Policy.

9. COMMUNICATION AND SUPPORT

9.1 Communication Channels
KnowGuard communicates with Users through:
· Email at the address provided during registration
· Messages within the Platform application
· Push notifications (if enabled)
· Telephone in urgent matters

9.2 Technical Support
KnowGuard provides:
· Support hours: Monday–Friday, 9:00 AM–5:00 PM CET
· Channels: Email (info@knowguard.eu), online form

9.3 Feedback and Complaints
The User may:
· Share feedback on courses
· Report errors in content
· File a formal complaint

All submissions will be processed within 7 business days.

10. LIABILITY AND INDEMNIFICATION

10.1 Damages and Claims
The User releases KnowGuard from liability for:
· Damages arising from the use of the Platform
· Content provided by third parties
· Service interruptions
· Loss of access to materials

10.2 Indemnification
The User undertakes to indemnify KnowGuard for:
· Claims by third parties arising from the User's breach
· Legal defense costs
· Penalties resulting from copyright infringement
· Damages caused by illegal activities

11. LEGAL PROVISIONS

11.1 Jurisdiction and Law
· The Terms are governed by Polish law
· The competent courts are those in Poland (KnowGuard's registered office location – Gdańsk)
· Disputes will be resolved in accordance with the Civil Code

11.2 Dispute Resolution
Before initiating court proceedings, the parties will endeavor to:
1. Mediation – amicable resolution within 30 days
2. Negotiation – agreement on terms
3. Court resolution – if previous steps fail

11.3 Court Proceedings
· Any legal action must be initiated within 3 years of the claim arising
· The User waives the right to class action lawsuits
· Each dispute will be resolved individually

12. AMENDMENTS TO THE TERMS AND TERMINATION OF THE AGREEMENT

12.1 Termination of the Agreement by KnowGuard
KnowGuard may terminate the agreement in the event of:
· Material breach of the Terms
· Actions threatening security
· Inactivity for 1 year
· Non-compliance with legal requirements

Termination requires 30 days' notice (except in security-related cases).

12.2 Termination of the Agreement by the User
The User may:
· Close the account at any time
· Log out of the Platform
· Request deletion of their data (by contacting the Data Protection Officer)

Closing the account does not automatically result in a refund for courses.

12.3 Effects of Termination
After termination of the agreement:
· Access to the Platform is blocked
· Data is processed in accordance with the Privacy Policy
· Certain provisions remain in force (copyright, limitations of liability)

13. ADDITIONAL PROVISIONS

13.1 Content Variability
KnowGuard reserves the right to:
· Remove or modify courses
· Update content without notice
· Change the technical Platform
· Transfer courses to another platform

13.2 Links to Third-Party Sites
The Platform may contain links to external sites. KnowGuard is not responsible for:
· Content of third-party sites
· Privacy policies of those sites
· Data security on those sites

13.3 Entire Agreement
These Terms constitute the agreement between the parties regarding the Services and supersede all prior agreements.

13.4 Severability
If any provision is deemed invalid, the remaining provisions shall remain in force.

14. FINAL PROVISIONS

By using the Platform, the User confirms that they:
· Have read these Terms
· Understand all provisions
· Accept all terms and conditions and limitations
· Will comply with all rules
